“My understanding based on information provided by the nurses is is incapable of providing a statement to police based on his cognitive abilities and coherency of thought, that sort of thing,” Babstock said. Defence lawyer Cletus Flaherty questioned Babstock on his confirmation of the complainant’s medical condition, arguing only specialist doctors would be qualified to determine the man’s abilities.

Flaherty suggested police had spoken with a woman earlier in the day on Aug. 14, 2019 about a report she had made of being assaulted by the complainant. The court saw photos of the broken window and other images captured inside and outside the home by RNC forensic identification officer Const. Dion Langdon, who was tasked with attending the residence after investigators obtained a warrant to search the house for the missing golf club shaft. He presented a series of 40 photos, including a blue golf club handle, its head cracked off and missing, lodged behind the door of a living room inside the home.

The officer told the court he had not discovered any blood in the porch or living room of the residence.
