A man crashed into one vehicle, fled the scene, then hit a concrete barrier in a St. John McDonald’s parking lot last month, according to Lake County court records.
Michael E. Phelps, 54, of Boswell, Indiana, is charged with battery against a public safety official, a Level 6 felony; operating a vehicle with an ACE of .08 or more but where defendant has a prior conviction, a Level 6 felony; and a litany of misdemeanors including OWI, resisting law enforcement, and leaving the scene of an accident.Around 6:17 p.m. on July 23, St.
The officer lowered Phelps to the ground, attempting to handcuff him, but Phelps tried rolling away from the officer. The officer cuffed Phelps and double locked them, court records state. The officer asked Phelps to get up off the ground, but he refused to stand so the officer physically picked him up, the affidavit states. The officer observed that Phelps was extremely unsteady and had to be held so he wouldn’t fall over.
The officer tried to speak with Phelps but he could barely string a few words together and his speech was extremely slurred. When the officer asked where he was, Phelps thought he was in Lafayette, court records state.
