Halton Regional Police have released the identity of a man shot dead during an alleged home robbery in Milton last weekend.
Mian’s arrest was immediately protested by his lawyer, Jag Virk, who claims his client should not have been charged.
According to Virk, Mian is a registered firearm owner and used his gun legally against an armed intruder, an intruder Virk claims was attacking Mian’s mother.claimed his client killed the intruder with a single shot and had not intended to kill him.he charges laid in relation to the shooting on Gibson Crescent in Milton are serious and are reflective of the evidence collected by homicide and forensic investigators.
The Milton home defence case is being compared to a similar case in Nova Scotia, where a resident stabbed an intruder to death in January. Based on the evidence gathered by police, the stabbing was considered an act of self-defence and no charges were laid.prosecutors apply the facts to the Criminal Code’s self-defence rules.
Deciding what level of force is “reasonable” in defending oneself involves a careful balancing act that values the general security of both parties involved.
