ACLU says action violated First Amendment rights.
Los Gatos Town Council will decide whether to revoke its censure of a planning commissioner at its Tuesday, April 18, meeting after the American Civil Liberties Union threatened to sue the town for violating that commissioner’s First amendment rights.on Feb. 15 after several residents complained that an email she wrote to the state , in which she said “rich, white, anti-housing men” were thwarting future housing development in town, was racist against White people.
Town Attorney Gabrielle Whelan, who served on the committee that determined Clark’s punishment, said in a staff report that she recommends removing the censure. The process used to discipline Clark has been under scrutiny not just from the ACLU but also the town’s former attorney, Rob Schultz. In text messages to the mayor that were obtained by a public records request, he said he was shocked to see the topic move to a public hearing.
