The judges who invalidated President Cyril Ramaphosa's decision to suspend Public Protector Busisiwe Mkhwebane have reiterated that their decision must be confirmed by the Constitutional Court – and rejected her bid for immediate reinstatement.

While Mkhwebane's advocate Dali Mpofu SC contended that the Western Cape High Court’s declaration that Ramaphosa's suspension of Mkhwebane was unlawful, did not require Constitutional Court confirmation, the judges who delivered the decision disagreed.
