Evidence leader advocate Nazreen Bawa SC, says they haven't had a lot of time to prepare for this approach. She says written questions are more labour-intensive. She doesn't want to cause a further delay, so she asks for two lists of questions with separate deadlines.Mkhwebane says she sent a letter through her attorneys that she won't be making an application for Dyantyi's recusal as she doesn't have attorneys.
Dyantyi says he is still waiting on an application for his recusal. He said on Wednesday that such an application could be lodged by 13 today, and he would respond by 13:00 on Monday.Dyantyi says all the members are in agreement with his proposal, and he indicated that he would amend the directives, so her point about directives is already catered for. He also indicated that her legal representation would be dealt with.
Mkhwebane says Ebrahim should be"very honest" with the committee going forward. She says she will engage with PPSA to have"legal representation of my choice".Mkhwebane says the process they now want to take is not in the directives and it is an"unlawful process", and it is exactly what the late Tina Joemat-Pettersson said they would do.Dlakude agrees with her colleagues in supporting Dyantyi's proposal"so that as this committee, we move forward".
DA MP Mimmy Gondwe supports Dyantyi's proposal."I look forward to us concluding the work we have started."Nkosi agrees with Dyantyi's proposal. He says Dyantyi must ensure throughout the process that it is seen to be open and transparent."I think that there are elements in both your proposals that cater for that," he says. He says they must not be seen to do this work"outside the public eye".
