LIVE | Judge gives Zuma, correctional services leave to appeal his medical parole ruling
Judge Matojane says that, among other things, another court may find that Zuma should be treated with compassion and humanity -"the essence of ubuntu" - because of his ill health and advanced age. This is in relation to his order that Zuma should return to jail and his time spent on medical parole not counted as part of his sentence.JUST IN: Judge gives Zuma, correctional services leave to appeal his medical parole ruling.
"The fact that a patient's treatment has been optimised and that his or her condition has been brought under control does not imply that he or she has been cured from a terminal disease or condition," it states.
Mpofu now contends that Matojane was wrong to find that none of the doctors involved in the medical parole process stated that Zuma had a terminal illness.2h ago But Matojane has found that he needed to do so on the recommendation of the medical parole advisory board, which is tasked with establishing whether – under the provisions of the Correctional Services Act – an inmate is “terminally ill and physically incapacitated” or “suffering from an illness that severely limits their daily activity or self-care”.Comment: Given Matojane's comments up until now, it would be surprising if he does not grant Zuma leave to appeal his medical parole ruling.
