For centuries Canadian law regarded the First Nations as incapable of owning land. Then in 1973 the late, in the Calder case, that Aboriginal title is recognized by Canadian law. I consider that Calder imposed a fiduciary duty on the Government of Canada, as trustee of the rights of Indians, to establish a tribunal and a procedure for determining the nature and extent of Aboriginal title in all of Canada and who owns those rights.

Instead, that government, through its law officers, continued its colonial practice of resisting claims made by Indians to the same kind of land rights as all other Canadians enjoy. In effect, the adversarial process of English law was given priority over the rights clearly recognized by Calder.
