Speaking on Sky News, he said: “I think the next Labour government will look very carefully at this legislation. We need to see how its working and if it is not working in the way the Government says it’s intended to work, then that is something that needs addressing.”“The police are operationally independent of Government, they’ll make these decisions based on what they think is best,” he told broadcasters in Hertfordshire.
Graham Smith raised concerns about the Public Order Act, signed into law last week, which gives police greater powers to clamp down on protesters by lowering the definition of “serious disruption”. The crime of conspiracy to cause a public nuisance was introduced under the Police, Crime, Sentencing and Courts Act 2022. But some of the protesters arrested reportedly said police cited new laws created under the Public Order Act.
“The whole thing was a deliberate attempt to disrupt and diminish our protest,” he said. “They stopped us because the law was introduced, rushed in last week, to give them the powers to stop us on any flimsy pretext.
