A federal appeals court panel has put a secret hold, for now, on the U.S. Department of Justice’s effort to access U.S. Rep. Scott Perry’s cell phone as part of a broader probe of efforts by former President Donald J. Trump and his allies to subvert the 2020 election.

But it is a victory for Perry in that it, for the moment, stays a decision by U.S. District Court Judge Beryl Howell that granted prosecutors access to Perry’s communications.PennLive’s attempts to reach Perry on the latest development were not immediately successsful, and an attorney working on his case declined comment since the proceeding is sealed. The DOJ press office did not respond, either.

During the now-defunct House Select Committee investigation into Trump’s ties to the Jan. 6, 2021 attack on the U.S. Capitol, a witness named Cassidy Hutchinson named Perry as one of several Congressmen who asked her boss, White House Chief of Staff Mark Meadows,Perry, who’s just begun his sixth term in Congress, has strenuously denied Hutchinson’s account about the pardon inquiry.
