The trial was set in January, but new evidence was uploaded in the case the weekend before it started. Balido said in the recusal hearing Tuesday that Givens made comments about Pittman’s “professionalism, her lackadaisical attitude and questioned her truthfulness at every occasion.” Defense attorneys said Givens was expressing her frustration with the delays in evidence turnover and that she was holding both parties accountable.
They called the recusal motion a tactic to delay the trial and accused prosecutors of venue shopping.
