Callaway was alleged to have entered the campaign to undermine former Wildrose Party leader Brian Jean’s battle against eventual winner Jason Kenney. Callaway dropped out of the race and endorsed Kenney, who went on to become premier. Both sides denied any collusion. Marion ruled the penalty handed to Park didn’t amount to a true penal consequence or was similar to a criminal prosecution. As a result he could not argue his Charter rights in proceedings in criminal and penal matters were violated.Article content
The judge also dismissed suggestions Election Commissioner investigator Dave Jennings and the commissioner himself had closed minds and prejudged the case.
