Judge in Senzo Meyiwa murder trial unhappy with side shows
Maumela’s sentiments during the trial on Tuesday were against the backdrop of an application for special entry tabled on Monday by defence Advocate Zandile Mshololo, who argued that the state had deliberately chosen not to disclose the existence of the second docket and consequently hampered her client’s right to prepare his defence.Maumela interjected when state prosecutor George Baloyi was telling the court that Mshololo had been aware of the second docket even during the process of the trial.
Maumela added that he had noted that the state’s process of handing over the second docket was not done simultaneously. “But that bus has already passed, and we seem to be running after it and picking up whatever the passengers are throwing through the window...”Thereafter, he requested a meeting with all parties in chambers to map a way forward for the trial.
Mshololo earlier confined her argument to the violation of section 86 of the Criminal Procedure Act, which provides that an accused person should be furnished with all the information for the preparation of their defence.
