The Eastern Cape health department has been granted a reprieve after Judge Robert Griffiths, of the Bhisho High Court, ruled on Tuesday that it no longer had to make upfront lump sum payments in medical negligence claims
.
The department approached the court after being slapped with a R35.4 million lawsuit by the parents of a baby who had developed cerebral palsy because of negligence by medical staff at the Cecilia Makiwane Hospital in Mndatsane in 2018. The child, who cannot be named to protect his identity, is now 11 years old. According to the court papers, the child was born after a prolonged labour and he suffered brain damage as a result.
