But even if that baseline intent requirement is satisfied here, what other crime or crimes is Bragg alleging? While the indictment doesn’t say, the statement of facts, combined with Bragg’s news conference and, suggest that he has election and tax violations in mind. But he didn’t detail how those potential crimes play into the case, nor do we know if he has other potential crimes in mind as well.
To be sure, as Bragg noted at his news conference, the indictment doesn’t have to specify what other crimes he has in mind. And he doesn’t need to prove that any other crimes occurred — rather, that Trump intended to commit, aid or conceal another crime. Still, given the intense legal speculation surrounding the precise issues of intent to defraud and other crimes, the public could have benefited from a more detailed explanation by Bragg on this score.
Pretrial motions can shed more light on the subject, and we may soon be analyzing more serious offenses anyway, if Trump is charged by the Department of Justice or in Georgia, or both. In the meantime, remember that we’re at the beginning of this New York case and don’t yet know how it will end.
