“They sent further emails. They applied to the web portal. They had people on their behalf calling the hotline hundreds of times and they were met with no actual responses,” Maureen Silcoff, a lawyer for the group, said on Friday. The long wait, they say, violates their right to life, liberty and security under the Charter of Rights and Freedoms. The mandamus application was filed last September but has only been unsealed this month with personal information redacted for the safety of the applicants in Afghanistan.
, including translators, drivers, cleaners and cooks, who risked their lives to support Canada during the war in Afghanistan as NATO forces were withdrawing. While awaiting for a response from Canada, he and his family received death threats from the Taliban and went into hiding. Last August, a year after his email, immigration officials issued them an invitation to take the next step and fill out detailed application forms to apply to the program, but the family has not been informed of the processing time nor is that information public.
The law firm that employed the other applicants, Shajjan and Associates, had been retained by Canada since 2013 and its connection with the country is widely known in Afghanistan. The risks and threats that came with that were corroborated by an official at Canada’s Justice Department and a former consul at the embassy.
