Law enforcement authorities have formally opposed Dr Nandipha Magudumana's challenge to what she describes as her"abduction" in Tanzania – but it has been Home Affairs Minister Aaron Motsoaledi who has been the most vehement in his defence of her arrest.
But that defence may come back to haunt the minister, with Magudumana's lawyers expected to argue that Motsoaledi's own account of how she was apprehended shows that she was effectively the subject of an unlawful rendition back to South Africa. These tensions are expected to play out in the Free State High Court in Bloemfontein on Friday, when Magudumana's urgent challenge to her arrest has been set down for hearing. Given Motsoaledi's determination that his department should be allowed to give evidence in that case, however, it is very likely to be postponed – so that Home Affairs can apply to be joined as a party in the case.Get 14 days free to read all our investigative and in-depth journalism.
