Govender's attorney, Ravindra Maniklall, submitted an affidavit to the court stating that his client intends to plead not guilty to the murder charge. Maniklall dismissed the allegation of pre-meditated murder as absurd. Govender, a father of three young children, emphasized that during an identity parade, the sole eyewitness failed to identify him.

He believes this will ultimately lead to his exoneration. Govender stated that the witness had ample opportunity to familiarize themselves with his face through media coverage and social media for 11 days, yet still couldn't identify him. He expressed his belief that the police are yet to apprehend the actual perpetrator, asserting that it is a case of mistaken identity. He highlighted the extraordinary fact that the single eyewitness could not identify any suspects fleeing the crime scene. Govender further claimed that he willingly surrendered to the police upon receiving a call.As the sole director of Pro-Secure, Govender explained that his business relies heavily on his involvement. The company employs thousands of people, with an annual salary bill exceeding R180 million. He argued that no one else is capable of managing his business effectively, and his incarceration would jeopardize the livelihoods of his employees
