Ferrel and Darren Govender appeared in the Durban Magistrate’s Court facing murder charges in connection with the death of Shailen Singh. The State contested their bail application, arguing they were attempting to manipulate the situation and lacked genuine cooperation with authorities.
The Govender brothers, Ferrel and Darren, are facing charges of murder for the death of Shailen Singh , a businessman, who was killed on December 29th at Meridian Drive in Umhlanga. Fourteen spent cartridges were found at the crime scene. During the bail application at the Durban Magistrate’s Court, the State argued that the brothers were attempting to manipulate ordinary circumstances into exceptional ones to secure bail.
The State prosecutor, Seema Reddy, stated that the brothers, through their affidavits, were attacking the State's case and demanding supporting evidence. Reddy emphasized that the State is not obligated to prove its case beyond a reasonable doubt at a bail application stage. She stressed that an applicant challenging the State's case must provide substantial proof on a balance of probabilities that they will be acquitted.Counsel for Darren Govender argued for a schedule five bail application under the Criminal Procedure Act. However, Reddy countered that the evidence presented suggests a schedule six offence, prompting the court to further investigate this matter. The brothers, who are businessmen, claim they cooperated with the police and surrendered themselves. However, Reddy disputed this, highlighting Ferrel's alleged threat towards the investigating officer and their unavailability to authorities. She also stated that Darren intended to flee to Johannesburg instead of cooperating. The State emphasized that a witness failing to identify the brothers during an identification parade does not automatically exonerate them. Furthermore, they argued that the brothers' charitable donations and claims of financial hardship due to their business, Pro-Secure, are not compelling reasons for granting bail. Reddy pointed out that Ferrel resigned as director of Pro-Secure on December 13th, 2022, and Darren's spouse is a senior nurse, suggesting alternative financial support
