A coroner and a leading expert both rubbished claims from Lancashire council workers who suggested a six-inch deep crack which killed a cyclist could have closed up - and then reopened - on its own.

The team of four highways operatives who were sent to Island Lane to assess the road for any defects in need of repair were not shown the pictures. When they visited the road, on September 15, they all failed to spot the crack. In what was described as a 'puzzling' twist during the first day of proceedings, Mr Treen was asked how he could have missed the large crack, to which he said "I didn't miss it, it must have been repaired" before suggesting the crack must have "closed up on its own".

"I can only say that that puzzles me," he said. "I am not aware of any mechanism that would likely have caused that crack to be there on September 9, then to not be there on September 15 but then return on January 2." In his final submission, barrister Alex Williams, who represented Harry's family on behalf of Cycling UK, described the crack as a "trench". He added that the suggestion put forward by Mr Treen was so "vanishingly rare" it could be discounted entirely.

The coroner will also issue a Prevention of Future Deaths report; the wording of which will be confirmed at a later date. Coroners can make reports to a person, organisation, local authority or government department or agency where they believes that action should be taken to prevent future deaths.
