Fourway Mall owners scores a win in R1bn court battle over Covid-19 claim
Accelerate Property Fund and Azarert, the joint owners of Fourways Mall, have won a court battle against insurers as it seeks a R1-billion payout for Covid-19 business interruption.
At the heart of the dispute was whether infectious and contagious diseases were part of the agreement following a complex series of events and iterations of the contract. Defendants had also argued that the contract stood to be rectified and that necessary payments hadn't been made by the insured.
