The city’s own attorney had warned that the “Map 103” adopted by the city council in March could open up Morgan Hill to litigation
Former Morgan Hill Mayor Steve Tate and a handful of residents are suing the city of Morgan Hill over a redistricting map that they argue violates state law.
Map 103 was adopted in a narrow 3-2 vote on March 2 and keeps the city’s internal borders almost exactly the same, barring some minor changes between a few city blocks. At stake in the lawsuit is the makeup of District D, the easternmost portion of the city that is split into two large chunks and separated in the middle by unincorporated county land.
City officials must move fast to resolve the situation. State rules require that Morgan Hill finalize its redistricting map by April 17, and if the court finds that the map violates the law, a judge will end up choosing a new redistricting plan for the city. During those deliberations, Morgan Hill’s attorney Donald Larkin told councilmembers that noncontiguous borders violated state law and that litigation against the city was possible.
