Former IWK Health Centre CEO Tracy Kitch is escorted out of Halifax provincial court by sheriff's deputies Wednesday after she was sentenced to five months in jail and a year’s probation for defrauding the Halifax hospital of more than $43,000.
“This offence has tarnished the reputation of the IWK and impacted the public’s faith in all public servants,” the judge said. Crown attorneys Peter Dostal and Alex Keaveny had asked for a sentence of nine months in jail and two years’ probation. Defence lawyers Brian Greenspan and Jacqueline King recommended an 18-month conditional sentence and two years’ probation.
The Crown called evidence from 18 witnesses and tendered more than 70 exhibits over 11 days of testimony at the trial last November and December. The exhibits included a report by forensic accountant Alex Nunez, who examined $143,730 in expenses incurred by Kitch during her three years as CEO of the hospital.
Kitch did not call any evidence at trial. Her lawyers argued the Crown did not lead any evidence of deceit. They pointed out there were no false receipts generated, no overt lies and that Kitch relied on her executive assistant to ensure her expenses were accurately tracked. She reimbursed the hospital for some of the expenses before she stepped down, and the rest was repaid shortly afterward.
