Judge blocks WOTUS rollout in Texas, Idaho

In his ruling, Judge Jeffrey Brown, a Trump appointee in Texas's Southern District, found the Environmental Protection and Army Corps of Engineers,"do not have unbridled jurisdiction to regulate all the nation’s waters.""I will always fight to keep Biden’s boots off the necks of Texans!" he wrote. The Texas Farm Bureau was one of 16 industry groups to file a legal challenge to WOTUS earlier this year, claiming the rule was unclear and would require farmers to hire teams of consultants and attorneys to determine whether waterways on their property were under federal protection.

"Texas farmers and ranchers cannot know whether their property or project contains WOTUS, because the rule is hopelessly vague,” said Russell Boening, president of the farm bureau. “The rule reaches far too broadly to cover wet patches and areas that are usually dry or remote from navigable water."
