A lawyer representing the family of a man who was shot and killed last month by a police officer has sent a tort claim notice of wrongful death, negligence and excessive force against the Lawrence Police Department.
Police said Trotter did not comply with officers’ directions and produced a weapon as officers approached his car. Police refused to release information on what weapon Trotter had. In the tort claim notice, the attorney requested officials with the Lawrence Police Department, the Indianapolis Metropolitan Police Department, as well as other local officials preserve evidence related to the fatal shooting.
The claim is meant to put the opposing party on notice that a subsequent lawsuit may be filed, Cardella said. Under Indiana Law, notice to government employees must be given before a lawsuit is filed, he said.
