However, as often happens in hard, emotionally charged cases, most of the suggested reforms are likely to prove unconstitutional, ineffective or both.premiers sent to Prime Minister Justin Trudeau. Perhaps the premiers really meant that we should lock up anyone who poses a threat and has been charged with a crime. Yet that’s exactly what the law permits right now: According to the Criminal Code, bail can be denied when “detention is necessary for the protection or safety of the public.” It seems that the premiers are here unwittingly endorsing the current system rather than proposing a way of strengthening it.

While the premiers’ letter is typical of the shortsighted suggestions that abound in hard cases, there have, fortunately, been a few more thoughtful recommendations. Notably,that “there are a small number of prolific and violent offenders who continue to present a danger to society when released, and we need to find common sense reforms that will address those cases.”
