OAKLAND — After a week of tense deliberations, a jury’s attempt to kick out their “unruly” colleague and a juror’s refusal to return to the deliberation room, an Oakland man was acquitted of murder, court records show.
Jurors deliberated for a week before acquitting Ward of the only charges that would have sent him to prison for life, occasionally asking for readback of testimony from key witnesses or jury instruction on a state law provision that dictates defendants must be found not guilty if there is one reasonable theory that points to innocence.
While most of the court process is public by nature, jury deliberation rooms are kept private under penalty of law. But court filings of correspondence between the jury and Judge Scott Patton have offeredOn the second full day of deliberations, the jury’s foreman — whose named is redacted from court records — wrote a letter to Patton asking if an “unruly” juror could be expelled.
