The criminal referral does not mean charges will be brought against the former president, but could prove a major blow as he campaigns to take power again in 2024

should face criminal charges over attempts to subvert the result of the 2020 election, a Congressional committee has recommended.

However, the committee is expected to hand over its swathes of evidence after an 18-month inquiry that has seen more than 1,000 witnesses interviewed and 10 public hearings examining the attack. Noting several Trump supporters who stormed the Capitol have already faced jail, Democratic congressman Jamie Raskin added: “Ours is not a system of justice where the foot soldiers go to jail and the ringleaders get a free pass.”Trump addressed a “Stop the Steal” rally in Washington DC on 6 January, 2021 hours before lawmakers were due to certify Mr Biden’s presidential election win, with his supporters then heading en masse to the Capitol.

Republican Representative Liz Cheney said: “Among the most shameful of this committee’s findings was that President Trump sat in the dining room off the Oval Office watching the violent riot at the Capitol on television. For hours, he would not issue a public statement instructing his supporters to disperse. Despite urgent please from his White House staff and others to do so.

In a “conspiracy to defraud the United States,” the committee argues that evidence supports an inference that Mr Trump and his allies “entered into an agreement to defraud the United States” when they disseminated misinformation about election fraud and pressured state and federal officials to assist in that effort.
