An indictment is voted on by a grand jury, which is a group of 23 people who hear arguments and review evidence presented by prosecutors in felony cases. The group then decides whether there is sufficient evidence to file charges, according to the NYPD.If the grand jury decides there is sufficient evidence for criminal charges, it presents an indictment to the court containing the criminal charges.
