I’m not a very fearful person. Perhaps it’s faith. Maybe it’s hubris. But I have never been the woman who shuddered at the thought of walking to her car after dark or worried a lot about threats to my safety.As a parent, my sense of danger is sharpened as it pertains to them. I want to do more to protect them from harm than I have ever been motivated to do for myself.

So what can we do to protect our children and one another from acts of violence? Common sense suggests that when we arrest a person on charges of violent crime, we should consider keeping them in custody until trial. I believe in the innocence of the accused until proven guilty. Still, wisdom demands that our criminal justice system get better at assessing risk on a case-by-case basis and protecting the public.

I’m more comfortable with this potential change to the constitution than I might otherwise be because of a separate bill already passed by the legislature setting out the judicial process by which the court may deny bail. If prosecutors request that bail be revoked, it triggers a pretrial hearing at which both prosecutors and defense counsel may argue for and against the denial, even allowing the accused to testify and call witnesses.

Structuring and funding a system that keeps our innocent children alive while reasonably protecting the rights of the accused is a good use of public funds.
