Gambling is illegal in Texas, including betting money or anything of value at any game played with cards, dice, balls or other devices. But, it is legal if the games occur in a private place, if no person receives any economic benefit other than personal winnings and if all players have an equal shot at winning except for the advantage of individual skill or luck.

But the ambiguity in a section of the law on who is and isn’t allowed to receive financial benefits from the games is among the key issues in dispute between some cities. Dozens of poker businesses operate around the state, like in Houston and Austin. Bricker, who lives in Dallas, began playing poker recreationally in 2016 and started participating in tournaments two years later. He said he’s been playing at Texas Card House since it opened in 2020. He described the business as professionally run and a safe option to enjoy the game.

“I think the public has a perception that since it exists that it’s regulated,” she said. “But allowing every city to interpret what the law might mean as it sees fit is how you end up in a situation like Dallas.” There are age requirements, and businesses also have the discretion to refuse business to potential customers.

Judge Moyé drew a similar conclusion that there are economic benefits other than players’ personal winnings, according to court documents.
