Permanent rules would give more time for tenants to talk with landlords and pay off rent to avoid an eviction suit.
But the proposed ordinance also requires property owners give tenants an opportunity to “cure” the breaches of their lease – that means tenants would get time to communicate with their landlord and pay rent, back-rent and fees before the landlord could begin the eviction process. Then, the tenant would have 20 days from the notice period to “cure” their lease requirements, Melton said. He also said that the draft’s language on when the 20 days starts is confusing and he is working with the city to seek more clear language.
“From a practical and operational standpoint, the ordinance will create additional complexity to the patchwork regulations that vary from city to city – a situation where a property on one street could have different regulations than a property the next street over,” Simon said. “That’s why the State of Texas governs the eviction process through the Texas Property Code, which ensures that procedures are balanced, fair, and equally and consistently applied statewide.
The Apartment Association of Greater Dallas said in a statement that it was not involved in the creation of House Bill 2035, but it supports a “common-sense public policy approach to reimagine temporary COVID-era assistance programs that were never intended to become permanent housing solutions.”
