Marquette told the Calgary Court of Justice judge that evidence from Howe alone is enough to find the city senior guilty.Defence lawyer Bath-Sheba van den Berg had challenged the validity of a reconstruction report by Const. Scott McCallum which said the deceased was in the crosswalk. But Marquette said the officer’s findings were based on the evidence from Howe, which should be accepted.
Heap struck Olver, 26, shortly after leaving work on the evening of May 24, 2021, at the Ace Liquor outlet in the Deer Valley Market Place. He was turning left onto Canyon Meadows from Deer Ridge Drive when he struck Olver, who was out with Howe walking their dog.“The roads were slick, the tarmac was wet and shiny.”“I was also looking to the left making sure no one was in the crosswalk,” he told van den Berg.A date for Fradsham’s verdict will be set next week.
