SINGAPORE: A court has dismissed an elderly woman’s clai
elderly woman’s claims for damages from a town council over injuries she sustained falling into an uncovered drain.
She argued that the town council had breached its duty of care. As a result, she incurred medical bills, transportation expenses and experienced pain and suffering. He said Mdm Chan had already crossed the drain once before the accident. He found that visibility in the area would not have materially changed in that time.
The judge added that Mdm Chan had “acted with full knowledge of the risk of harm when she chose to cross the perimeter drain at a location where it was uncovered”.
