The ruling, delivered by Judge Myburgh AJ on 17 September 2024, reaffirmed an earlier decision made on 13 September that stripped Khumalo and two others of their signatory rights.unsuccessful legal challengesfrom the MKP for allegedly attempting to"destabilise the party." The other expelled members included Ray Khumalo, Bheki Manzini, Rochelle Davidson and Lebohang Moepeng, who was also a signatory to the party's bank account.
The high court’s judgment stated that Khumalo"had no personal entitlement to the funds in this account." The court went on to criticise Khumalo's actions, saying his conduct"constituted a flagrant attempt to try and abuse the current situation to gain some other political advantage." Ndhlela said that Khumalo had tried to justify his claim to the party’s bank account by suggesting his expulsion was still under appeal, but this argument fell flat in court.This is false because his ill-fated appeal relates only to the issue of the face of the MK Party on the ballot paper, which has been long overtaken by events .
