The court dismissed the argument by Zuma and his uMkhonto weSizwe party that the remission of his 15-month sentence in 2021 for contempt of court meant that the prohibition in section 47 of the Constitution no longer applied to him. “This court finds that there is no difference between a conviction following criminal proceedings and a conviction following civil contempt of court proceedings since a person is convicted of a criminal offence in respect of both proceedings,” Theron said.
