In a recent book about Iacobucci, McGill law professor Shauna Van Praagh describes him and Johnston as having been good friends since graduate school. Both have been involved with the Trudeau Foundation — briefly and some time ago, in Iacobucci’s case, but still — and the Trudeau Foundation is itself very much part of the Chinese-money conversation.
Of course, Supreme Court judges haven’t exactly been covering themselves in glory lately. Iacobucci and John Major were both hip deep in SNC-Lavalin’s attempts to obtain a deferred prosecution agreement from the government. Many jurists seem increasingly perplexed by Beverley McLachlin’s continued presence on the Hong Kong Court of Final Appeal, which she continues to insist — against all evidence — is meaningfully independent from the communist regime in Beijing.
Outside of Quebec, where all governors general are at least a bit controversial for one reason or another, Johnston was essentially the perfect appointment for Rideau Hall. Zero controversy, start to finish. Conservatives and Liberals alike sang his praises, and they leveraged that cross-partisan respect — both before and after his tenure — by handing him several difficult files over the years.
