Possession of drug paraphernalia — such as pipes or bongs, but not marijuana itself — is a Class C misdemeanor, which is punishable by a fine up to $500, but no jail time.During the 2021 legislative session, both Republicans and Democrats in the Texas House made renewed attempts to lessen criminal penalties for marijuana possession. Some of the bills introduced included getting rid of jail time for possession of small amounts of marijuana and eliminating automatic driver’s license suspensions.
