Cleveland’s handling of Deshaun Watson is the latest example of an NFL team that said it conducted due diligence before acquiring a player with legal cases alleging misconduct with women but concluded its investigation without speaking to the women.

The deal was touted as the largest fully guaranteed contract in NFL history, but such guarantees typically protect player salaries only in matters of skill, injury and the salary cap. The Browns might have included language that terminates Watson’s contract if similar alleged conduct or accusations emerge again, said Sarah Cole, a professor specializing in labor and employment at Ohio State University.
By avoiding a conversation with Watson’s accusers, Livingston said, the Browns also eliminate the possibility of hearing new evidence. The result of the investigation then becomes a stalemate in which the information is filtered through people who have the most motivation to be biased.
