Constitutional Court strikes down section of Executive Ethics Code that does not require members of a party’s executive to declare the donations they get for party campaignsThe Constitutional Court on Tuesday ruled that members of political parties’ executive must disclose donations received for internal party campaigns, a move that’s likely to change the country’s political landscape.
The report was set aside by the Constitutional Court last year when it found there was no duty to disclose under the Executive Ethics Code because Ramaphosa did not personally benefit from the funds. In its judgment, the top court held that the purpose of the Ethics Act’s wide-ranging provisions is to ensure that members of the executive do not place themselves in compromising positions that may impair their ability to discharge their duties without any undue influence, which includes the acceptance of undisclosed financial contributions.
