ANC politician Pule Mabe failed to stop the SIU civil recovery action, leaving his Porsche Carrera and Steyn City property at risk over an irregular R27 million tender.
Senior African National Congress politician Pule Mabe is at risk of losing his Porsche Carrera and his Steyn City property after failing to stop a civil recovery action by the Special Investigating Unit. The Special Tribunal dismissed Mabe's application to halt the SIU's preservation order on assets that the unit alleges were bought through the proceeds of crime.
The ruling means the SIU's preservation order remains in force while the matter continues. Mabe had asked the tribunal to suspend action on his assets until his separate criminal case is finalized.
SIU Investigation and Tender Findings
In 2024, an SIU investigation found that Mabe unlawfully benefited from an irregular R27 million tender. The tender was awarded to his company, Enviro Mobi, by the Gauteng government.
The SIU concluded that the award was improper and that Mabe gained from it unlawfully. The unit then moved to recover assets it says were acquired with the proceeds of that tender.
After completing its investigation, the SIU referred the matter to the National Prosecuting Authority. That referral opened the path to both criminal and civil proceedings against Mabe and others linked to the tender.
Arrest and Ongoing Criminal Case
In October 2024, Mabe was arrested along with his associates. His case is still ongoing at the Palm Ridge Specialised Court.
In his application to the Special Tribunal, Mabe argued that the SIU must wait for his criminal matter to conclude before moving against his assets. He contended that allowing the civil recovery to proceed at the same time would prejudice his position in the criminal case.
The Special Tribunal rejected that argument. Its dismissal of his application clears the way for the SIU to continue pursuing the Porsche Carrera, the Steyn City property and other assets covered by the preservation order.
What the Ruling Means
The decision is a significant step in the SIU's efforts to recover state funds lost through irregular tenders. It also increases the pressure on Mabe as he defends himself in the criminal case at Palm Ridge.
Mabe remains a senior figure in the ANC, and the case is one of several tender-related matters involving public officials and state contracts. The SIU has pursued civil recovery in parallel with criminal referrals in such matters.
The legal process is continuing, and no final finding of guilt has been made in the criminal case. The civil recovery action, however, can now move forward while Mabe's criminal matter remains before the court.
