'She was unfairly reprimanded by Starbucks over symptoms believed to be COVID-19 related, when they were actually related to blood cancer'

Lisa Pedersen’s symptoms turned out not to be COVID, but a terminal form of blood cancer. The lawsuit, filed by Samfiru Tumarkin LLP, Canada’s largest employee-focused employment law firm, seeks damages of nearly $650,000 plus costs due to the profound impact on Pedersen’s ability to support her three children and her loss of vital benefits.

“The flexible schedule was incredible to handle my son’s unique circumstances. So, we would have lots of hospital appointments at the children’s hospital,” she said. “I did hope to retire at that company.” The claim alleges that in April 2021, Pedersen, who made just under $40,000 a year as a shift supervisor, informed her manager about feeling unwell, experiencing weakness, headaches and chills. She believed her symptoms to be related to menopause and she was requested to continue working due to a staffing shortage.

Pedersen said that her store manager and district manager terminated her employment and issued her three write-ups, which included attending work while sick, not following COVID protocols, and mishandling food safety measures. “I felt like it was a very hasty decision,” Pedersen said. “I just felt really let down and disappointed.”

“I had a life insurance policy through Starbucks,” said Pedersen. “I have lost that now, and I can’t get a new policy through any other insurance companies because you have to be cancer-free for five years, and my type of cancer, there is no cure.”Article content
