In March of 2021, Lewis was told that in order to receive a double lung transplant, she would have to take the COVID-19 vaccine. To date, she has refused to do so.
A judge with the Court of Queen's Bench of Alberta has ruled it is not unconstitutional for a double lung transplant candidate to be removed from the transplant list over her refusal to take a COVID-19 vaccine.
The woman was diagnosed with terminal Idiopathic Pulmonary Fibrosis in 2018 and was advised that she would not survive unless she receives a double lung transplant. The Edmonton Lung Transplant Program explained that lung donors are a scarce resource and the LTP has a waitlist mortality of approximately 20%, meaning one in five patients waitlisted will die prior to transplant.
The LTP determined that the absence of valid medical exemption supported by expert consultation is a contraindication to lung transplantation based on several factors including the risk an unvaccinated patient could pose to other transplant recipients.
