In a unanimous decision, a three-member Alberta Court of Appeal panel said provincial court Judge Greg Stirling did not err in sentencing James Oka.
“The crux of Mr. Oka’s argument is that Judge Stirling did not adequately account for his circumstances as an Aboriginal offender and the “genocidal nature” of the residential school system,” Wakeling wrote. “We are not persuaded that there is a basis for us to interfere with the sentencer’s decision and dismiss the appeal.”
He had picked up his victim in the Beltline area and drove her to a secluded gravel parking lot east of the Stampede grounds, where he choked the woman unconscious before raping her and leaving her bloodied from scrapes to her face.
