The R1.8 billion fraud and corruption case against former Bosasa chief operations officer (COO) Angelo Agrizzi and three of his co-accused is yet to get off the ground. Agrizzi, who made headlines at the State Capture Commission of Inquiry by implicating government officials and politicians in illicit deals, joined the proceedings virtually from Tuesday via a TV link, with his oxygen mask alongside him.
His lawyer, Cliff Alexander, told the court that there were still preliminary issues to be sorted out, leading to the provisional postponement of the case to June 12. The trial of his three co-accused, former Bosasa executive Andries van Tonder, former correctional services chief financial officer Patrick Gillingham, and former correctional services commissioner Linda Mti, was also provisionally postponed to the same date. The court was informed that these three are in the process of lodging an application against the Assets Forfeiture Unit (AFU) for “living and legal costs”. This follows the temporary attachment by the AFU of assets worth more than R53 million, including bank accounts, believed to be linked to the Bosasa corruption saga. The court heard that the three accused had previously launched an urgent application against the AFU for the release of funds for their living and legal expenses, but this was struck off the roll due to a lack of urgency. They are now pursuing a new application on the normal court roll, with no date set for the hearing yet. The AFU is opposing this application and has not yet filed its opposing papers. It is hoped that this application against the AFU will be finalized by June when the accused are due back in court. Meanwhile, Alexander informed the court that Agrizzi is unwell. His trial was separated from that of his three co-accused to ensure a speedy trial for them. Medical experts have stated that Agrizzi's medical condition prevents him from attending court hearings in person.
