A judge will rule Monday on Jovanny Crespo's motion for a mistrial.

“It has come to our attention that one of the seated jurors had prior knowledge and opinion of the case,” said the note, which Ravin read aloud in court. The note asked the judge for further instruction. Ravin then summoned attorneys for both sides. Deputy Chief Assistant Prosecutor Alexander Albu countered that instead of declaring a mistrial, the judge should instruct the jury disregard any prior knowledge or opinion of the case and focus on the evidence.
The state alleges that Crespo jumped out his patrol car at the three locations during the chase and opened fire in an unjustifiable use of deadly force that violated state Attorney General guidelines.
