The organizations argue that the Act's implementation is irrational and unconstitutional, citing President Ramaphosa 's decision to promulgate the Act in its entirety despite recommendations from Minister Gwarube to postpone its implementation.

Gwarube had recommended a delay due to the absence of adequate norms and standards, particularly regarding the language and admissions policies outlined in Clauses 4 and 5 of the Act. These clauses grant the Department of Education control over admissions regulations and require school governing bodies to submit their language policies for approval from the provincial head of the department. Significant criticism from political parties, including the Democratic Alliance (DA), the Freedom Front Plus (FF Plus), and AfriForum, had initially led to a postponement of the Act's implementation and a three-month consultation period.During this period, parties were expected to engage in dialogue and reach consensus on the contentious clauses. However, AfriForum and Solidarity contend that Ramaphosa, after the consultation period ended, signed a Presidential Proclamation in December to fully implement the BELA Act, disregarding Gwarube's recommendation for a delay. They maintain that the proclamation is illegal and unreasonable, stating that the Act's implementation should be halted until clear and comprehensive norms and standards are established. Both organizations have threatened legal action if a settlement cannot be reached with the President and Minister Gwarube
