Poland's populist ruling party must weigh their desire for autocracy against their wish for pandemic recovery aid from the EU
amid the covid-19 crisis, last week the European Court of Justice took a modest step towards stopping a European Union member from sliding into autocracy. Ever since it won power in 2015, Poland’s populist Law and Justice party has been trying to get control of the country’s courts, while independent judges appeal to theordered Poland to suspend immediately the disciplinary chamber of its Supreme Court, a body that can punish judges, and to freeze a new law restricting judicial independence.
has challenged the order in Poland’s constitutional court, which is currently dominated by government-friendly judges. But that court has no authority in the case: thelaw. Its orders “cannot be questioned on the basis of national constitutions, national law or rulings of national courts”, says a European Commission spokesman. If Poland sets aside the verdict, it will be defying the court, the commission and the structure of theIt is shaping up to be a fateful spring for Polish democracy.
