Arguing in the Gauteng High Court in Johannesburg on Tuesday, Ian Allis said his client Dieter Bergs did not shoot his wife Genèe in their home eight years ago.
Asked what motive the gardener had to commit the crime, Allis said:"Why would the accused have done this? He has no motive."Court to rule if man, 87, can be held liable for wife's murder after being declared unfit for trial"The fact that we have two people on the property is suddenly ruled out that the accused is the only suspect."There was no one else in the house. The staff live on the property, but not in the house.
The State claimed that Bergs was going to be the beneficiary of a R4 million policy upon Genèe's death. Bayat and her team had not been able to trace the policy or whether it had been paid out. "There is no evidence of financial difficulties. Those statements were made only by parties who would inherit [from Genèe's will] . If Mr Bergs is excluded, they would inherit more. Nowhere has it been proven that he had a financial dependency on the deceased.
In August 2016, Genèe's daughter lodged a formal complaint with the provincial police commissioner and the National Prosecuting Authority. This led to an inquest in 2017 at the Gauteng High Court in Johannesburg. The court concluded that Bergs be charged for the alleged crime.
